Philippine Judicial History In The Making

The last few days have proven very exciting for the Philippine nation and her people. And as planned. In the early part of July 7th,  5 Archbishops, 3 Bishops, and 1 Reverend, among other petitioners, had filed a petition with the Supreme Court for certiorari and prohibition with preliminary injunction and a temporary restraining order seeking to assail and stop the ComElec’s unconstitutional juggling of billions of pesos of the tax payers’ money intended to lease 93,977 new variant OMR/PCOS machines for P12.6 billion in gross violation of the 2015 General Appropriations Act, Article VI, section 25(5) of the Constitution and the rulings of the Supreme Court to the DAP cases to the injury and insult of the people. Not to mention the resulting discard of the 81,000+ old PCOS machines which had already cost P9 billion in lease and purchase costs. [1][2]

MORE ACTIONS WILL BE FILED IN THE NEXT FEW DAYS

Bishop Broderick S. Pabillo (Auxiliary Bishop of Manila/CBCP Media Office), the AESWatch (composed of more than 40 civil society groups) and several prominent civil society members will also file a separate petition with the Supreme Court against the COMELEC for violation and/or failure to comply with the provisions of the Automated Elections Law (R.A. No. 9369, as amended) and the sham or simulated biddings designed to favor SMARTMATIC.

Another group, Transparent Elections, will also file a separate petition with the Supreme Court against COMELEC and SMARTMATIC for giving the latter under preference in the bidding process.

IN THE SEASON OF “WHERE IS GOVERNMENT VERSUS ALLEGED GREAT PLUNDERER” TURF WAR, AND THE DISMAL WEAKENING OF DEMOCRATIC INSTITUTIONS, THE CHURCH MAY YET OFFER A STRONG MORAL COMPASS TO GUIDE THIS INCREASINGLY WAYWARD GOVERNMENT BACK INTO THE PATH OF TRUE PUBLIC SERVICE BY ITS ACTIVE INTERVENTION WITHIN THE BOUNDS OF LAW AND THE CONSTITUTION. IN NOWHERE IS THIS ACTIVE INTERVENTION MORE TIMELY AND SIGNIFICANT THAN IN INSURING THAT OUR ELECTIONS SHALL REMAIN TRULY TRANSPARENT AND CREDIBLE, FOR THE WHOLE GAMUT OF PUBLIC GOVERNANCE BEGINS IN ELECTIONS.
